Terms of Service

Soapy Joe's Laundry Service ("Soapy Joe's") is pleased to provide garment care to you ("you" or the "Customer"), subject to your compliance with and acceptance of the terms and conditions set forth below. Please read the following provisions carefully. Your use of the Soapy Joe's service indicates your agreement to be bound by the terms and conditions contained herein. If you do not so agree, you should inform us and cease using the service immediately. This agreement is strictly between Soapy Joe's and its customers and does not in any way constitute or imply any relationship with any other parties.

Delivery Schedule:

Soapy Joe's will pick up the customer's garment bag at the designated drop-off times for the customer's specific building. Delivery of the clothing occurs at least two (2) business days after the time of pickup. Pickup and delivery will occur each week on Monday through Friday, except on Independence Day, Memorial Day, Columbus Day, Christmas Day and New Year's Day. Soapy Joe's reserves the right to determine the pickup and delivery times in its sole discretion and reserves the right to reschedule such times upon prior notice to the front desk of the customer's building.



Pick Up and Delivery, Procedure and Terms:

Soapy Joe's will provide the customer with identification cards after the initial garment submission. Soapy Joe's reserves the right not to pick up items that are not identified with the customer's identification cards, but may decide to pick up such items in its sole discretion. The customer agrees not to include any of the following that are in or attached to any of the items to be cleaned or inside any of the customer's garment bags: (i) non-washable items, (ii) items that are labeled for hand washing and/or dry-cleaning only, or (iii) any other items not meant for laundering or dry-cleaning. The customer is responsible for any and all damage caused by any items left in the customer's clothing or garment bag that cause damage to the clothing of any customer, the cleaning machines, or any other property of Soapy Joe's or its customers. Soapy Joe's is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the customer or the front desk for pickup or delivery.

Payment:

The customer must pay the agreed-upon charges prior to service. There is a 10 pound minimum for wash and fold orders. Each customer is required to have credit card information on file with Soapy Joe's. Soapy Joe's will charge the customer's credit card once each week for services rendered. If a credit card on file is denied, Soapy Joe's will send an invoice to the customer for all amounts then due. Any account that has not been paid within ninety (90) days of the date of service, for whatever reason, will be subject to an automatic $25 late fee charged to the customer's account. Inventory Sheets:

Inventory sheets for each pickup are available at http://www.soapyjoes.com/residential/faq.php or at the front desk of your building. Inventory sheets are to be used for the sole purpose of keeping track of items. Soapy Joe's, in its sole discretion, may chose not to fulfill requests put on inventory sheets. All information provided on the inventory sheets by the customer shall be accurate in every way. Soapy Joe's is not responsible for any items not listed on the inventory sheets. The customer agrees to complete an inventory sheet for all items inside the Soapy Joe's garment bag. If any items are left without an inventory sheet, Soapy Joe's reserves the right to complete one based on the items inside the bag without notice to the customer. If there is a discrepancy between what is listed on any inventory sheet and the actual items left in the bag, Soapy Joe's reserves the right change the inventory sheet and, based on a careful examination, make the final determination about the actual contents of the bag without notice to the customer. The customer hereby consents to any such changes. Soapy Joe's does not consent to the accuracy of any inventory sheet completed by the customer.


Garment Care:

Soapy Joe's will use reasonable efforts to maintain a high quality cleaning service. Soapy Joe's accepts no liability for damage due to normal cleaning of items without care instructions, and accepts no liability for items treated in accordance with the care labels or other instructions provided. Soapy Joe's accepts no liability for "special care" items that require special attention to be cleaned or that do not have care instructions; provided, however, Soapy Joe's will take special care of items that are placed in a separate plastic bag (provided by the customer) located within the customer's garment bag if the plastic bag is clearly labeled "delicates." Soapy Joe's is not responsible for clothing bleeding, shrinking, or otherwise changing as a result of normal washing procedures. Precautions will be taken to alleviate these problems if possible. Soapy Joe's reserves the right to refuse to clean any garment. Soapy Joe's does not guarantee the removal of all stains. Soapy Joe's will have its cleaning service re-clean items that, in its sole discretion, were not properly cleaned and have not been worn since they were cleaned. Soapy Joe's is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or garment bags such as money, jewelry, or any other item. The customer agrees not to leave such items in its clothing or in its garment bags.


Loss or Damage:

In the rare instance that your garment is lost or damaged by Soapy Joe's, we will issue you a refund or credit for the value of that garment, as specified in the National Fair Claims Guide from the International Fabricare Institute ("IFI"). This guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, the customer can attest to the age but Soapy Joe's, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), Soapy Joe's may use the replacement cost of a comparable item currently available. Notwithstanding the foregoing, the maximum reimbursement for each individual item is $300 and the maximum total reimbursement per customer is $1,000. Although Soapy Joe's is not liable for damage or loss due to the fault of its third-party cleaners or service providers, we may, in our sole discretion, chose to reimburse the customer in these events pursuant to the IFI standards described above.

We are not liable for any preexisting damage to garments. If we find any preexisting damage or have a concern about the colorfastness, or the age or weakness of the fabric, we will contact you to obtain your approval before proceeding to care for the item. If we are unable to obtain your authorization in a timely manner, then we may return the item without cleaning it. We are also not liable for any damage caused by the customer placing dry-cleaning in a laundry bag, or laundry in a dry-cleaning bag.

By signing the sale receipt at the front desk of the building, you acknowledge that all garments submitted for cleaning were returned. Soapy Joe's is not responsible for lost garment claims made after you sign the sale receipt to obtain clothing. If there is a discrepancy, please leave your order with the front desk and contact Soapy Joe's before signing the sale receipt.

Damaged or missing items must be reported to us within three (3) days of delivery of the item(s). If you believe that Soapy Joe's is in possession of an item but we have no record of its pickup, we request that you inform us immediately so we can start an investigation and you can search at home. If, after seven (7) days, the item has not been found, we may compensate you for the loss of the item in accordance with the IFI guide, at our discretion.




Use of Third-Party Service Providers:

Soapy Joe's or its associates will deliver the customer's items to and from a laundering and dry-cleaning service of Soapy Joe's choice. Soapy Joe's reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, in its sole discretion, without notice to the customer. Soapy Joe's is not responsible for, and will not be held liable for, any damage or loss due to the acts or omissions of its vendors, third party outsourcers, or service providers.


Disclaimer:

In no event will Soapy Joe's be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not Soapy Joe's knew or should have know of the likelihood of any such loss or damages. Soapy Joe's disclaims all warranties, express or implied, with respect to the services rendered to the customer.


Venue and Choice of Law:

Any suit involving any dispute arising between Soapy Joe's and the customer may only be brought in the Southern Division (Greenbelt) of the United States District Court for the District of Maryland, or in any Maryland State Court having jurisdiction over the subject matter of the dispute or matter. Soapy Joe's and the customer hereby irrevocably consent to the exercise of personal jurisdiction and venue by any such court with respect to any such proceeding. These terms of service and the relationship between the parties shall be interpreted, construed, and governed according to the internal laws of the State of Maryland, without reference to its choice of law rules.
